This action will be for the purchasers of the common stock of Caraco Pharmaceutical Laboratories, Ltd. (AMEX: CPD), between May 29, 2008 and June 25, 2009.
The action will allege that Caraco Pharmaceutical Laboratories, Ltd. and certain of its executive officers violated federal securities laws. Specifically, the action will allege that statements made by the Company between May 29, 2008 and June 25, 2009 were false and misleading and failed to disclose or indicate, among other things, that the Company was repeatedly noncompliant with FDA requirements for the safe production of medication and failed, on many occasions, to correct known deficiencies that the FDA warned the Company about.
The truth of the Company's repeated failure to comply with government regulation was revealed on June 25, 2009, when the U.S. Marshals, at the request of the FDA, seized drugs from the Company's manufacturing plants. On the news of the seizure, the Company's share price closed down over 40% from the previous day's close on unusually heavy volume.
